In Brief

Ten students challenged the Admission Supervisory Committee's decision to cancel their MBBS admissions at Malabar Medical College. Although the students missed the online application deadline of 09.09.2016 due to a website snag, they later applied pursuant to a College notice dated 23.09.2016 (issued following an ASC order) with proof of demand drafts obtained before the deadline. They were admitted on 28.09.2016 with NEET-based merit but their admissions were cancelled on 03.06.2017. The Supreme Court held that since no candidate with higher NEET rank was denied admission, the students had proof of prior financial commitment, and the disapproval came nine months after notification by the university, cancellation on purely technical grounds was inequitable. The Court set aside the High Court's order and allowed the appeal, permitting the students to continue their studies.
