Apollo Zipper India Limited sought to evict W. Newman and Co. Ltd. from a commercial premises in the Great Eastern Hotel, Kolkata. The suit premises was originally leased at Rs. 40,000 per month. After the State acquired the hotel in 1975–1980, and later vested it in Apollo Zipper in 2005, Apollo served a quit notice in 2012 and filed a summary eviction suit. The tenant disputed the appellant's title and argued the rent was actually Rs. 1,600, making the West Bengal Premises Tenancy Act applicable instead of the Transfer of Property Act. The Supreme Court held that the tenant had attorned (accepted the new ownership) through conduct, the rent was indeed Rs. 40,000, and no arguable defence existed.
