Anju Kalsi's son, a debit card holder with HDFC Bank, was covered under a group insurance policy. After his death in a road accident, the insurer (HDFC Ergo) rejected the claim, stating he had not made a non-ATM card transaction in the preceding three months—a condition of the enhanced coverage. The Supreme Court held that because the insurer never proved the policy terms were communicated to the account holder, and the bank declined to participate in proceedings, the account holder was entitled to the basic insurance amount of Rs 5 lakhs, not subject to undisclosed conditions. The judgment was allowed with interest and costs."
