Supreme Court of India 2020-04-17 dismissed

Anjuman E Shiate Ali & Anr vs Gulmohar Area Societies Welfare Group & Ors. etc

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Two plots in an approved residential layout were originally designated as open spaces or garden areas for public benefit. The appellants sought to construct on these reserved plots. The Supreme Court upheld the protection order and held that plots designated as open spaces in an approved layout cannot be converted for construction purposes. Development Plans do not override such original reservations, and appellants cannot retrospectively claim the layout was temporary to justify the change. The appeal to allow construction was dismissed to preserve public green spaces.
