The Municipal Corporation of Mumbai challenged a High Court order granting relief to tenants whose superstructures were demolished for road widening. The Supreme Court dismissed the special leave petitions, holding that the High Court's findings—that the demolition was high-handed and structures pre-existed 1961—could not be overturned absent perversity. Since the Corporation itself conceded that most tenants were eligible for alternative accommodation, the Court found no grounds to interfere. It upheld the High Court's balanced approach, granting alternative premises to eligible tenants and permitting the original owners to seek Transferable Development Rights.">
