Anubhav Kumar Choudhary & Ors vs Union of India & Ors

Bench: 2 — Abhay Manohar Sapre

In Brief

Anubhav Kumar Choudhary sought relief against a High Court order that granted him liberty to file a representation before the National Thermal Power Corporation (NTPC) but barred him from returning to court on the same issue. The Supreme Court held that while the High Court correctly granted administrative remedies, it erred in stripping away the fundamental right to pursue legal remedies thereafter. The Court ruled that citizens cannot be arbitrarily denied access to courts without justification, and affirmed that the appellant retains the right to pursue all available legal remedies if the representation receives an adverse decision.
