Arawali Power Company Pvt. Ltd vs Joginder Singh Tokash & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Arawali Power Company and land owners challenged the High Court's determination of compensation (L 29,00,400/- per acre) in a land acquisition case. The Supreme Court upheld reliance on bonafide 2010 sale deeds to value 2007-acquired agricultural land, but rejected a 70% deduction based on a single-marla 2007 deed sold for residential/commercial use. The Court approved the 12% per annum deduction applied by the High Court but added an approximate 15% development deduction that was omitted, reducing compensation to L 25,00,000/- per acre plus statutory benefits. The Company's appeals were partly allowed; owners' cross-appeals were dismissed.
