Arrive Safe Society of Chandigarh vs Union Territory of Chandigarh & Anr

Bench: 3 — D.Y. Chandrachud

In Brief

Arrive Safe Society challenged Chandigarh Administration's 2017 notification re-classifying certain arterial roads (V1, V2, V3) from state highways to major district roads, arguing it circumvented the Supreme Court's K. Balu judgment restricting liquor sales near highways. The Supreme Court dismissed the petition, clarifying that K. Balu applies to highways providing inter-city/inter-town connectivity, not roads within municipalities classified as highways for administrative maintenance purposes. The re-classification did not breach the judgment as it left unaffected National Highway 21 and Madhya Marg. The Court clarified that its liquor prohibition order does not restrict licensed establishments within municipal areas.
