In Brief
Appellants challenged a charge sheet for dowry-related offences and alleged marriage fraud under the IPC. The High Court dismissed their petition. On appeal, the Supreme Court found that the FIR allegations disclosed a prima facie case of dowry demand under the Dowry Prohibition Act, so those charges could not be quashed. However, regarding the IPC Section 493 charge (false representation of lawful marriage), such allegations existed only against appellant no. 1 and did not constitute a substantive offence; the Court therefore quashed the IPC charges. The appeal was partly allowed.
