Arvind Kumar Gupta vs Principal Secretary, Medical Health & Family Welfare Uttarakhand & Ors

Bench: 2 — Kurian

In Brief

Following the bifurcation of Uttar Pradesh under the Uttar Pradesh Re-Organisation Act, 2000, a Drug Inspector was officially allocated to Uttarakhand but wished to remain in Uttar Pradesh on personal grounds. The Supreme Court held that, given his long and uninterrupted service in Uttar Pradesh since 2007, he should not be disturbed. The Court disposed of the appeal, declaring that the appellant shall be treated as an employee of Uttar Pradesh and is entitled to all consequential benefits from his 1999 appointment.
