In Brief
This appeal concerns an employee (Drug Inspector) allocated to Uttarakhand following the bifurcation of Uttar Pradesh under the 2000 Re-Organisation Act, who wished to remain in Uttar Pradesh on personal grounds. After continuing uninterrupted service in Uttar Pradesh since 2007, he sought protection from transfer. The Supreme Court held that given his long and uninterrupted service, the employee should not be disturbed and shall be treated as an employee of Uttar Pradesh, entitled to all consequential benefits from his original 1999 appointment. The appeal was disposed of.
