Ashatai w/o Anand Duparte vs Shriram City Union Finance Ltd

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A widow filed a consumer complaint against a finance company challenging wrongful loan recovery proceedings. The District Consumer Forum and National Commission's orders were challenged in this civil appeal. The Supreme Court found the National Commission's order unjustified and set it aside. The Court held that the widow was unnecessarily subjected to litigation due to the finance company's deficiency of service. Accordingly, the appeal was allowed and the respondent finance company was directed to pay compensation and costs to the appellant widow for the unwarranted legal proceedings.
