In Brief

The Assam Industrial Development Corporation challenged a High Court order that had annulled the original land acquisition award for a plastic park and allowed fresh acquisition proceedings. The Supreme Court held that once a land acquisition award is approved, compensation paid, and possession delivered to the acquiring authority, the land vests absolutely in the State. The Government cannot re-acquire land already vested in it. The Court found the original award was approved on 05.03.2010 based on a combined reading of correspondence and subsequent conduct of all parties. Therefore, fresh proceedings initiated in 2012 were void and infructuous, and cannot be used to nullify the original award.
