Land was acquired in 2002 under the old Land Acquisition Act, 1894, but the award determining compensation was passed in 2016, after that Act was repealed and replaced by the 2013 Act. The landowner challenged the award, arguing it should be determined under the old Act rules. The High Court dismissed the challenge, holding compensation would be calculated using 01.01.2014 (the new Act's commencement date) as the base date. The Supreme Court affirmed, holding that the date for compensation must follow statutory prescription, not be arbitrarily chosen, and that the landowner is entitled to the benefit of the new Act's provisions.
