Two civil appeals challenged the National Consumer Disputes Redressal Commission's order deleting a developer company from a consumer complaint filed by an association of flat buyers regarding a real estate project. The Supreme Court held that deletion was unwarranted at the admission stage. Relying on the Real Estate (Regulation and Development) Act, 2016, Section 2(zk), the Court clarified that both an entity constructing a building and an entity selling apartments are jointly liable promoters when they are different persons. Given the complaint's averments that the deleted respondent was the principal promoter and the counter-affidavit confirming contractual links, the order for deletion was set aside and the respondent was restored as a party."
