An association of flat buyers filed a consumer complaint against real estate developers seeking possession of flats, common amenities, and restraining additional charges. The National Consumer Disputes Redressal Commission deleted one developer (Three C Universal Developers) from the proceedings, finding the buyers did not contract directly with it. The Supreme Court reversed this, holding that under the Real Estate Regulation Act 2016, both the entity constructing and the entity selling apartments are joint promoters and liable. At the admission stage, deletion was premature; the NCDRC must proceed with both defendants and determine liability at final hearing."
