Aviation Travels, a travel company, was sued for Rs. 1 crore in damages for allegedly causing harm to trust property during renovations. An ex-parte decree was passed against it in 2003 when no written statement was filed, despite the company having engaged advocates through a Power of Attorney. After 15+ years, the company sought to set aside the decree. The Supreme Court allowed the appeal and restored the suit for trial, finding that the company deserved an opportunity to contest the substantial damages claim. The Court ordered the company to deposit Rs. 35 lakhs as security and file its defense within four weeks, holding that damages must be assessed through evidence from both parties."
