The Supreme Court examined whether the original owners of a leased shop (initially a partnership firm, later reorganized as a co-ownership firm) could evict an ongoing tenant. The tenant challenged their locus standi, arguing that no proper notice of change of ownership or attornment occurred. While a tenant cannot normally challenge the landlord's title, the Court held that a tenant may challenge the derivative title of a successor-in-interest if no attornment has been created. The appellants failed to adequately prove their title through documentary evidence. The Court remanded the matter to the High Court for fresh examination, allowing the appellants to produce additional evidence establishing how their title was derived from the dissolved partnership firm.
