Avinash Hitech City 2 Society and others appealed against orders refusing to refer disputes with Boddu Manikya Malini and another to arbitration. The disputes arose from an Addendum to a Supplementary Development Agreement containing an arbitration clause (Clause 19). The respondents had initiated proceedings under the Andhra Pradesh Societies Registration Act instead. The Supreme Court held that the arbitration clause was binding and the disputes must be referred to arbitration under Section 8 of the Arbitration and Conciliation Act, 1996. The Court set aside the lower court orders and directed the disputes to arbitration.
