Azizia Bee @ Shaik Mujeeb (D) Thr. Lrs vs Govt. of A.P. & Ors

Bench: 2 — R.F. Nariman

In Brief

The appellants claimed title to land in Hyderabad based on a 1961 compromise decree and 1962 sale deed. The Division Bench had upset a lower court's favourable decision by improperly mixing the appellants' land (Survey No. 129/45/D) with a different property (Survey No. 403 part) that had been allotted to Andhra Prabha Publications. The Supreme Court held that the two properties are distinct and separate. The appellants' title is clear and free from evacuee and urban land ceiling restrictions. The Government's allotment to Andhra Prabha Publications covered only the different survey number, not the appellants' land. The Court set aside the Division Bench's order and restored the single Judge's directions, allowing the appeals.
