Azizia Bee @ Shaik Mujeeb (D) Thr. Lrs vs Govt. of A.P. & Ors

Bench: 2 — R.F. Nariman

In Brief

This case concerns competing claims to land in Jubilee Hills, Hyderabad. The appellants claimed title through a 1961 compromise decree and 1962 sale deed. A government order allotted land to Andhra Prabha Publications, leading to urban land ceiling proceedings. While both lower courts held the appellants did not have evacuee issues and their lands were not liable for third-party allotment, the Division Bench confused two separate survey properties and upset that order. The Supreme Court held the Division Bench erred in mixing two distinct land parcels and restored the single Judge's order, confirming the appellants' title and that their land (Survey No. 129/45/D) was unaffected by the government allotment of separate land (Survey No. 403 part).
