B.B.M. Enterprises vs State of West Bengal and Anr

Bench: 3 — R.F. Nariman

In Brief

B.B.M. Enterprises challenged an arbitration award before the High Court in a Section 34 petition seeking to overturn the arbitrator's decision on factual grounds. The High Court remanded the matter, finding the District Court lacked sufficient reasoning. The Supreme Court held that courts cannot re-examine an arbitrator's factual findings or substitute their interpretation for the arbitrator's. The District Court had provided adequate reasons for dismissing the petition. The Court affirmed the District Court's order, reduced the interest rate from 18% to 15%, and granted three months for payment of the balance amount.
