B.K. Pavitra and Ors vs Union of India and Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

This batch of cases challenges the constitutional validity of the Extension of Consequential Seniority to Government Servants Promoted on the Basis of Reservation Act, 2018, and the Karnataka Government Servant (Seniority Rules) 1957. The Supreme Court upheld the validity of the Reservation Act, finding the constitutional challenge lacking in substance. Following its earlier decision in B.K. Pavitra I, the Court confirmed that the State government properly analysed data on compelling factors. The Court held that Article 309 empowers the Governor to frame rules governing seniority of promoted government servants. All writ petitions, review petitions, and miscellaneous applications were dismissed with no order as to costs.
