Supreme Court of India 2018-02-23 dismissed

B. Muthukrishnan (Dead) by L.Rs vs S.T. Redddiar Educational & Charitable Trust & Ors

Bench: 2 — Abhay Manohar Sapre

In Brief

The Supreme Court dismissed appeals challenging the High Court's modification of interim stay orders relating to trust properties and a temple. The underlying Regular First Appeal was still pending in the High Court. The Court held that when interim orders are made in a pending appeal, it is not appropriate for the Supreme Court to interfere with them at that stage. Instead, the proper course is for the High Court to dispose of the substantive appeal on merits, after which the legality of interim orders can be examined if necessary. The Court directed the High Court to expeditiously decide the pending appeal.
