A deceased tenant (Channappa Poojary) had occupancy rights in agricultural land. During the pendency of his application for formal occupancy rights, he died. The appellant—the deceased's nephew—claimed a Will bequeathing the rights to him, and the Land Tribunal granted occupancy rights to the appellant without notifying the deceased's legal heirs (spouse and minor son/respondent). The respondent, upon attaining majority, challenged this order through a writ petition. The Supreme Court held that the Land Tribunal committed manifest jurisdictional error by proceeding without the legal representatives on record. Further, the transfer by Will to the appellant—not a member of the defined 'family'—violates Section 21 of the Karnataka Land Reforms Act, 1961. The Court upheld the remand order, directing the Tribunal to reconsider whether such a transfer is legally permissible.
