Channappa Poojary, a tenant with occupancy rights, filed an application before a Land Tribunal in 1974 seeking formal occupancy rights under the Karnataka Land Reforms Act. He died in 1979 during the pendency of the application. His nephew (the appellant) claimed Channappa had executed a will in his favour and obtained an order granting occupancy rights in 1980. The deceased's son, Respondent No. 1, later challenged this order through a writ petition. The High Court set aside the tribunal's order as a nullity, noting the tribunal lacked jurisdiction to decide the matter without bringing the legal representatives of the deceased tenant on record. The Supreme Court upheld this decision, holding that such transfers of tenancy rights to non-family members are prohibited under Section 21 of the Act and the tribunal must determine whether the appellant is a legitimate legal heir before considering the will's validity."
