A wife filed a transfer petition seeking to move her husband's divorce petition from the Gurugram Family Court to Gwalior, where she resides. She argued that the considerable distance made it difficult for her to defend the petition effectively. The husband did not object to the transfer. The Supreme Court held that transfer was warranted under Section 25 of the Code of Civil Procedure, 1908, and directed the divorce petition be transferred to a competent court at Gwalior to enable the wife's effective defence and expeditious disposal.
