BABITA SRIVASTAVA vs VINOD SRIVASTAVA

Bench: 1 — B.V. Nagarathna

In Brief

The wife-petitioner sought transfer of her husband's divorce petition from the Family Court at Gurugram (Haryana) to Gwalior (Madhya Pradesh), where she resides. The respondent-husband did not object to the transfer. The Supreme Court held that the considerable distance between the two cities and the petitioner's need to effectively defend the proceedings warranted the transfer. The petition was allowed, and the case was directed to be transferred to a court of competent jurisdiction at Gwalior to facilitate the petitioner's participation."
