An employee of a dairy cooperative was terminated in 1996 for unauthorized absence. The Labour Court set aside the termination as disproportionate, but the Industrial Court and High Court upheld it. After the employee's death, his legal representatives appealed to the Supreme Court. The Court held that reinstatement was no longer practicable after 22 years and evidence that the deceased had acquired other means of livelihood. In the interest of justice, the Court awarded compensation of Rs. 2 lacs to the legal representatives in full settlement of all claims arising from the employment.
