Saryug Singh (dead) Through Lrs vs National Seeds Corporation and Anr

Bench: 2 — Kurian

In Brief

The widow and legal representatives of a deceased employee challenged a High Court order limiting compensation to Rs. 50,000 in a case where the employee had voluntarily relinquished service by failing to report for duty after 1986. The Supreme Court upheld the High Court's rejection of a claim for full back wages spanning 23 years, finding this to be a case of voluntary relinquishment rather than unlawful termination. The Court awarded additional compensation of Rs. 1 lakh to the widow in full and final settlement, payable within six weeks, with 12% per annum interest from the date of death if delayed, and made the responsible officer personally liable for non-compliance."
