Bangalore Development Authority vs N. Jayamma

Bench: 2 — A.K. Sikri

In Brief

The Bangalore Development Authority acquired land including the respondent's property through notifications under the Land Acquisition Act. The respondent claimed she had perfected title through adverse possession by occupying the property for over 12 years. The trial court and High Court decreed in her favour. The Supreme Court reversed both decisions, holding that the respondent's claim failed on multiple grounds: the sale to her after preliminary notification was void; she possessed the land for only 7 years before demolition; and her possession was not peaceful and continuous as required for adverse possession. The Court allowed the BDA's appeal and dismissed the respondent's suit."
