Basavaraj alias Basavannappa Parmeshwar Bangargir vs State of Maharashtra

Bench: 3 — Navin Sinha

In Brief

The appellant was convicted under Section 302 IPC for murdering his father during a nighttime incident in December 2003. There was no eyewitness, but circumstantial evidence established guilt: the appellant had a motive (dispute over land), was present near the fields at the time, his blood-stained clothes were recovered at his instance, and he absconded and did not participate in funeral rites. The Supreme Court upheld the conviction, finding the chain of circumstances conclusively proved beyond reasonable doubt, despite absence of an eyewitness or blood on the murder weapon."
