BATESWARI DAYAL MISHR SHIKSHA SAMITI vs MADHYA PRADESH NURSES REGISTRATION COUNCIL

Bench: 2 — Rohinton Fali Nariman, Vineet Saran

In Brief

A nursing college sought recognition to run M.Sc (Nursing) and B.Sc (Nursing) courses for the 2018-19 academic session. The Madhya Pradesh Nurses Registration Council rejected the application, citing an incomplete submission without supporting documents. The college challenged this before the High Court and later appealed to the Supreme Court. The Court held that the college's application form was incomplete with no documents attached by the prescribed deadline, and its university affiliation certificate was issued only after the deadline expired. Additionally, the college lacked its own parent hospital (minimum 100 beds) as required by nursing regulations. The appeal was dismissed, upholding the Council's denial of recognition."
