PT. BATESWARI DAYAL MISHR SHIKSHA SAMITI vs Madhya Pradesh Nurses Registration Council & Ors

Bench: 2 — R. F. Nariman, Vineet Saran

In Brief

A nursing college sought recognition from the Madhya Pradesh Nurses Registration Council to run B.Sc (Nursing) and M.Sc (Nursing) courses for the 2018-19 academic session. The institution had operated B.Sc (Nursing) since 2006 but failed to renew recognition under new 2018 regulations. The Supreme Court held that the institution's incomplete application form, submitted without the required affiliation certificate (which was obtained only after the deadline), could not justify granting recognition. Additionally, the absence of a parent hospital with minimum 100 beds disqualified the institution under Indian Nursing Council guidelines. The appeal was dismissed as regulatory requirements were not satisfied."
