The Supreme Court upheld the National Green Tribunal's decision quashing the Environmental Clearance for a proposed eight-lane Peripheral Ring Road in Bangalore. The Court held that the project commenced on the final notification (29 June 2007), triggering the 2006 EIA Notification, and qualified as an expressway requiring prior clearance. The appellant violated mandatory procedural timelines by submitting the EIA report five years after the prescribed deadline, using outdated primary data, and failing to disclose forest land diversion and the actual number of trees to be felled. The SEAC improperly granted clearance without proper appraisal. The Court directed the appellant to conduct a fresh, sector-specific EIA and ensure full compliance with all statutory requirements before reapplication.
