Benson George vs Reliance General Insurance Co. Ltd. & Anr

Bench: 2 — M.R. Shah

In Brief

A 29-year-old process supervisor at Deutsche Bank suffered catastrophic brain injuries in a motor accident in 2013, requiring multiple surgeries and leaving him in a coma for eight years, permanently bedridden. The Motor Accident Claims Tribunal awarded Rs. 94.37 crore, which the High Court enhanced to Rs. 1.24 crore but awarded only Rs. 2 lakh for pain/suffering and Rs. 1 lakh for loss of amenities. The Supreme Court held that compensation for pain and loss of amenities cannot follow a rigid formula but must fit the claimant's specific circumstances. It enhanced the awards to Rs. 10 lakh each for pain/suffering and loss of amenities, bringing total compensation to Rs. 1.41 crore, finding the original awards unreasonably low given the claimant's permanent disability.
