Sri. Benson George vs Reliance General Insurance Co.Ltd.& Anr

Bench: 2 — M.R. Shah, B.V. Nagarathna

In Brief

A young Deutsche Bank employee suffered severe brain injuries in a 2013 car accident, undergoing multiple surgeries and remaining in coma and bedridden for eight years. The High Court awarded Rs.2,00,000 for pain and suffering and Rs.1,00,000 for loss of amenities. The Supreme Court partly allowed his appeal, holding that compensation under these heads cannot follow a rigid formula but must fit the facts. Given the claimant's prolonged hospitalization, grievous injuries, multiple operations, and permanent bedbound condition, the Court enhanced both awards to Rs.10,00,000 each, bringing total compensation to Rs.1,41,94,333 with 6% interest.
