In Brief
The Supreme Court dismissed an appeal challenging a High Court order that nullified a land sale to a Scheduled Caste buyer from Punjab. The land in Rajasthan was allotted to a Scheduled Caste person of that state. The Court held that a Scheduled Caste person residing in one state cannot claim Scheduled Caste status protections in another state, even if the same caste is recognized in both states. Scheduled Caste protections under Section 42 of the Rajasthan Tenancy Act are state-specific and tied to local disadvantages. Additionally, the compounding order granted by the Board of Revenue was invalid as actual possession had already been handed over to the original allottee. The appeal was dismissed.
