In Brief

The Supreme Court upheld compensation of Rs. 4 lakhs per acre for land acquired in Village Sohana under notification dated 26.10.1990. Land owners argued compensation should be based on higher amounts awarded for land in nearby Village Kambali and subsequently acquired land in the same village. The Court held that Kambali and Sohana are not adjacent but substantially distant. Market value cannot be determined retrospectively using later notifications, and compensation for the same acquisition (Village Lakhnaur) that attained finality provides the appropriate benchmark. The appeals were dismissed.
