Bharat Coking Coal Ltd. & Ors vs Shyam Kishore Singh

Bench: 2 — R. Banumathi, A.S. Bopanna

In Brief

An employee of Bharat Coking Coal Ltd. claimed his date of birth in service records (04.03.1950) was wrong and should be corrected to 20.01.1955 as per his matriculation certificate. The High Court accepted his claim, ordering the company to correct the record and pay one year's salary. The Supreme Court reversed this, holding that correction cannot be granted at the end of a career (30+ years later) when the employee had consistently indicated the same date in official forms and had ample earlier opportunities (1987, 1998) to rectify any error. The delay in seeking judicial remedy—four years after retirement—was fatal to the claim."
