Bharat Coking Coal Ltd. & Ors vs Shyam Kishore Singh

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court set aside a High Court order granting relief to an employee seeking to correct his date of birth in service records. The employee had indicated his date of birth consistently when joining service and in subsequent forms like the Provident Fund Nomination Form. More than 30 years later, he sought correction and filed a writ petition after retirement, four years after his initial representation. The Court held that such delay and failure to pursue the matter promptly precluded judicial relief. The Court emphasised that employees must exercise due diligence within a reasonable time to challenge service record discrepancies.
