In Brief
The widow and children of a 52-year-old man who died in a motor accident appealed against inadequate compensation awarded by the Tribunal and upheld by the High Court. The Supreme Court enhanced the compensation by adopting a multiplier of 11 (instead of 6.31), awarded Rs. 1,00,000 each for loss of consortium to the widow and for loss of love/care/guidance to the children. The Court applied 9% interest from the claim date and 15% enhancement for future prospects, clarifying that such enhancement is available even for deaths after age 50. The Insurance Company was directed to deposit the revised amount within three weeks.
