Bhogireddi Varalakshmi & Ors vs Mani Muthupandi & Ors

Bench: 2 — Kurian

In Brief

In a motor accident death case, the widow sought enhanced compensation on grounds of inadequacy. The original tribunal awarded a low multiplier of 6.31 and minimal consortium and funeral amounts. The High Court partially increased the multiplier to 8 but failed to apply correct principles. The Supreme Court held that the multiplier should be 11 per Sarla Verma precedent. The widow is entitled to Rs. 1,00,000/- for loss of consortium and children to Rs. 1,00,000/- for loss of love and care. For the deceased aged above 50, an additional 15% enhancement for future prospects applies. Interest at 9% is granted from the date of filing the claim petition.
