Bhoopendra Singh vs State of Rajasthan & Anr

Bench: 2 — Dr Dhananjaya Y Chandrachud, B V Nagarathna

In Brief

A widow of a co-conspirator in a premeditated murder was arrested and charged in a case concerning the killing of Daansingh, who was a key witness in a prior attempted murder trial. The High Court granted her fifth bail application, noting she was female, had served over three years in custody, and faced no direct allegations. The Supreme Court reversed this, holding the High Court erred: the charge-sheet established she used multiple SIM cards to contact the hired assassin, knew of weapon storage, and allegedly tracked the victim's movements. The Court found the High Court failed to consider the crime's gravity, her alleged direct involvement, and the absence of changed circumstances justifying bail after four prior rejections. The appeal was allowed and bail was cancelled."
