Bhupendra Ramdhan Pawar vs Vidarbha Irrigation Development Corporation, Nagpur and Ors. etc

Bench: 2 — Rastogi

In Brief

A farmer challenged the compensation awarded for 9.98 hectares of agricultural land acquired by the government for an irrigation development project. The High Court had awarded Rs. 1,00,000 per hectare for 7.98 hectares and separate compensation for orange and other trees. The Supreme Court held that the land compensation is fair and adequately supported by sales data. However, it allowed the farmer's appeal regarding 2 hectares of land for which no compensation was awarded, finding that when land value is determined from sales statistics, trees must be valued separately. The Court awarded Rs. 1,00,000 per hectare for the 2 hectares with statutory entitlements including interest until full realization, and rejected the claim for mango trees due to lack of evidence at the time of acquisition."
