Unitech Limited challenged a Supreme Court order distributing Rs. 98.07 crores from land sale proceeds to two individuals (Naresh Kempanna and Col. Mohinder Khaira) without adjudicating their claims. The Court found it had committed an error in paying Rs. 56.11 crores and Rs. 41.96 crores respectively to them without first determining their entitlement, as Unitech was the absolute owner with no title vesting in either recipient. Applying the principle of restitution and the maxim "actus curiae neminem gravabit" (the Court's act shall prejudice no one), the Court directed the recipients to return the amounts with 9% interest within four weeks, while preserving their right to seek adjudication of their claims through appropriate proceedings.
