The Medical Council of India (Appellant) challenged a Rajasthan High Court order directing it to conduct an inspection of National Institute of Medical Sciences' post-graduate courses. The respondent college sought to increase seats in M.S. (Orthopedics) and M.D. (Radio Diagnosis). The Supreme Court held that the High Court's interim inspection order was flawed because it lacked notice to the Appellant and full appreciation of the material. It found that an inspection within one week lacks the necessary surprise element and that no purpose is served by inspecting before adjudicating the pending substantive dispute about the admission bar. The Court set aside the interim order and allowed the appeal.
