C. ANIL CHANDRAN vs M.K. RAGHAVAN AND OTHERS

Bench: 2 — Hima Kohli, Rajesh Bindal

In Brief

An engineering graduate appointed as Overseer Grade-III on compassionate grounds was later directed to be appointed as Assistant Engineer. Years later, diploma holders received backdated promotions to the same rank from an earlier date, which the graduate engineer claimed affected his subsequent promotion chances. The Supreme Court dismissed his appeal, holding that the final seniority list had never been challenged by the diploma holders and could not be reopened. Furthermore, since different quota categories apply to graduate and diploma holders for the next promotion level, the backdating did not adversely affect the graduate engineer's prospects. The appeal was dismissed as lacking merit.
