Siraj Ahmad, appointed as Junior Engineer on an ad hoc basis in 1987 after open selection under state recruitment rules, was denied promotion despite obtaining his B.Sc. Engineering degree in 1987. The State promoted his juniors in 1995 but refused the appellant's promotion, citing lack of Public Service Commission concurrence in his initial appointment. The Supreme Court held such appointment was merely irregular (not illegal) given substantial compliance with rules and open selection. Since the appellant's services continued uninterrupted until regularization, they must be counted for promotion. The Court declared the appellant entitled to promotion from the date his junior employees were promoted, with full consequential benefits.
