The CBI appealed against a High Court order allowing a revision petition in a case involving offences under the Indian Penal Code and the Foreign Contribution (Regulation) Act, 1976 (FCRA). The Supreme Court limited the notice to the question of FCRA's applicability. The Court held that since the matter was pending before the Chief Metropolitan Magistrate and adequate material was lacking, the issue of FCRA applicability could not be decided at that initial stage. The Court deferred the determination until after the prosecution adduced evidence, directing the trial court to then record its findings and dispose of the case within one year.
